General Conditions of Use

The object of this document is to define the terms for the use of the website by the user and the information and services present and placed at the user’s disposal on the website.

Definitions

Each of the following terms shall have the meaning given in its definition in these General Conditions of Use and in any supplementary documents.

"General Conditions of Use": refers to this document.

"Website": refers to all the information and services provided by the France GBC association and made available to users via www.francegbc.fr.

"User": refers to any physical person who accesses the website.

"IP Address": refers to a number automatically assigned to the user's computer by the user’s Internet access provider when he or she browses on the Internet.

"Cookie": refers to a small file that is automatically installed in the user's browser software and allows the site to register information related to the browsing.

"Content": refers to all the data and, more generally, the information made available on www.francegbc.fr.

"Link" or "Hyperlink": associates a word, expression or image of a document to another part of a document or to another file. A click on a hyperlink allows access to any file on a distant server.

Object

Any access and/or use of the www.francegbc.fr website presupposes unconditional acceptance of and respect for the entirety of the terms of these General Conditions of Use in force on the date on which they are consulted. The user declares that he has read, understood and accepted them.

As such, they constitute a contract between the service and the user.

In the event that the user does not wish to accept all or part of these General Conditions of Use, he is requested not to use the service.

Access and use of the website are strictly reserved for non-commercial ends.

Special Conditions

Some services may have their own Conditions of Use ("Special Conditions"), which may complete or, in some cases, replace these General Conditions of Use. Where these exist, said conditions may be accessed in the sections in question.

Amendments to the General Conditions of Use

France GBC reserves the right to modify the General Conditions of Use at any time and without prior notice.

The date of entry into force of the new General Conditions of Use is the date on which they are put online; the user is deemed to have accepted the most recent version in force every time he accesses the website.

Contents of the website

All of the information available on the website is provided for information purposes and on a non-contractual basis.

France GBC shall do all it can to provide information that is available and accessible services to the user, but cannot guarantee the availability of this information or these services.

France GBC is solely responsibility for information that is available and services that are accessible. It shall ensure, to the best of its ability, the exactness of this information and that it is up-to-date and reserves the right to amend it at any time and without prior notice.

Publication of the website

The publication of the website is incumbent upon France GBC, the headquarters of which are established at 4 avenue Recteur Poincaré - 75016 PARIS registered under number R.N.A. : W751206739, published in the Official Journal on 30/10/2010, directed by a Board of Directors composed of titular members, elected for three years by the General Meeting.

Intellectual property Rights

All of the contents of the website (in particular, the catalogue of projects and achievements, studies, documentation and statistical analyses, the architecture and tree structure, texts, graphics, photographs, etc. appearing or available on the website), unless otherwise stated, and, more generally, all the elements making up the website are protected by Intellectual Property rights and are the exclusive property of the France GBC.

All the trademarks, logos and images referred to on the website belong to their respective companies and bodies.
All the information presented, as well as the documentation, studies, etc. of third-party bodies or companies are their property. France GBC’s liability may not be engaged in relation to the exactness of this data.

The reproduction of any of the contents published on the website is authorised solely for information purposes for personal, private use.

The user undertakes, in this regard, without this list being exhaustive, not to use, reproduce, represent, disseminate, adapt or, more generally, make use of the contents of this website, protected by intellectual property rights, without the explicit authorisation of the France GBC.
Thus, any use, representation, reproduction, modification, publication, transmission or denaturation, which is not expressly authorised, of all or part of the website or its contents, by any means whatsoever, shall constitute an act of counterfeiting punishable under Articles L 335-2 et seq. of the Intellectual Property Code.

Refusal to accept these General Conditions of Use shall release the association France GBC from any contractual or criminal liability or any other legal action, from any damages, direct or indirect, irrespective of the nature thereof, including financial or commercial, resulting from the use of the website or any information obtained on the website.


Collection of information of a personal nature

The user gives his or her express consent to data of a personal nature being collected in the context of his or registration for the services that may be accessed on the website.
Pursuant to the provisions of the Data Protection Act of 6 January 1978, France GBC undertakes to collect, use or store data of a personal nature of the user strictly only for the purpose of managing the services offered and may not transfer them to third-parties, individuals or companies, either for free or for payment. Effinergie undertakes not to keep the personal data any longer than is needed for the realisation of the ends for which it was collected or processed.

The website may contain links to other sites that may or may not belong to it. These websites are independent from the website www.francegbc.fr and, accordingly, France GBC does not assume any liability regarding the availability of these websites, their content, advertising, products or services, or any possible collection or transmission of personal data on or from those websites.
The links to these websites do not constitute any approval or validation whatsoever of their content by France GBC.
France GBC underlines that these websites have their own Conditions of Use.

The user of the site is authorised to insert a hyperlink to the www.francegbc.fr website without the prior, written consent of France GBC, which reserves the right to demand the deletion of a link if it considers that the referrer does not respect the rules set out in these General Conditions of Use.

Cookies - IP Address

Effinergie reserves the right to install cookies in order to manage the website better, facilitate browsing of the website, for the purposes of statistics and carrying out analyses of the number of visitors for the purpose of improving the website.
The cookies do not allow the user to be identified.
The user may refuse or delete the cookies by modifying the parameters of his browser. Effinergie reserves the right to record the user's IP address, in particular in order to identify him or her, if Effinergie deems it necessary in order to ensure that its Conditions of Use are respected or to protect its services, its information or at the request of the legal authorities.


Technical recommendations and responsibility regarding browsing

Effinergie tries to ensure the greatest possible access to its website. However, access to the website will be optimised if the following browsers are used: Microsoft Internet Explorer (version 6 or later) and Mozilla Firefox (version 3.0 or later).

Effinergie may not held liable for any damage whatsoever, direct or indirect, and, in particular, any commercial, moral or financial damages or any loss of profits, the cause, origin or source of which may have been use of the website or its contents, following a connection to the website, nor even in the event of all or part of the website being modified, suspended, interrupted or terminated.

Effinergie may not in any event be held liable for the reliability of the transmission of data, the access times or any possible restrictions on access to the Internet network or networks connected to it.
Effinergie’s liability may not be engaged in the event of interruption of the networks accessing the website, the total or partial unavailability of the website, in the event of a transmission error or problems related to the security of transmissions, in the event of failure of the user’s equipment or means of reception.

Effinergie may have to interrupt access to the website for maintenance reasons. This interruption may not engage its liability or create any right to compensation.

Competent jurisdiction and applicable law

These General Conditions of Use (GCU) are subject to French law.

If, in the event of a dispute, an amicable solution cannot be found and as a solution cannot be arrived at through conciliation, the parties shall submit the dispute to those courts which France GBC explicitly designates as being competent.

In the event of a dispute in relation to the interpretation, execution or validity of these GCU, the competent court shall be Tribunal d’Instance of Montpellier. In the event of a dispute with a physical person, the competent court shall be that of the place of residence of the physical person.

The fact that all or part of the provisions of these General Conditions of Use is deemed to be null and void pursuant to a law, regulation or decision of a court shall not in any way imply that the other provisions or the party not concerned by this nullity are or is null and void. They shall retain all their legal value and import.
